Consultation on Modern Interface Leased Lines Markets Remedies

The Authority is consulting on Modern Interface Leased Lines markets remedies. The Authority conducted a Consultation and market review of the fixed telecommunications markets on the Isle of Man in 2019 with the Fixed Market Response to Consultation, Notification of Market Power Determinations and Decision Notice published in November 2019.
As part of that notification, the Authority found that the Wholesale market for on-island Modern Interface Leased Lines was susceptible to ex ante regulation, and that Manx Telecom (MT) had Significant Market Power in that market. The Authority imposed a number of obligations on MT, including obligations relating to access; non-discrimination; transparency; accounting separation; and cost accounting and price controls. In its 2019 Decision Notice, the Authority signalled that it would review the implementation of the price control obligation, particularly with reference to areas where Licensed Operators are building out their own infrastructure.
The purpose of this Consultation is to review the Authority’s approach to the implementation of margin squeeze obligations in the wholesale market for on-island Modern Interface Leased Lines. The Authority’s review considers the following:
- Changes in the Retail and Wholesale on-island Modern Interface Leased Lines markets since the publication of the Decision;
- Geographic dimension of the Retail and Wholesale markets for on-island Modern Interface Leased Lines; and
- Regulatory options.
