25/25: Preliminary Relevant Market Definition

The Communications and Utilities Regulatory Authority (“the Authority”) published a notice in April 2025 stating that it was investigating a complaint made by Bluewave Communications Limited. The Complaint alleged that e-llan Communications Limited and/or Manx Cable Company Limited were engaging in anti-competitive practices relating to providing access to the e-llan subsea fibre optic communications cable (https://www.cura.im/media/1984/20250410-information-notice.pdf 09/25).

As the first stage of the Investigation, the Authority contacted industry stakeholders to determine the extent of the Relevant Market and the distribution of market power within it. 

Following this engagement, the Authority is today publishing its preliminary definition of the Relevant Market on the Isle of Man and its initial assessment of market power.  It is now inviting representations on these preliminary findings.  Once any comments have been reviewed and a final decision on the Relevant Market has been made, the Authority will be in a position to assess the allegations and issue a preliminary determination as to whether a breach of the Communications Act 2021 has occurred.
